Q. What are the U.S. guidelines for food and agricultural exports to Cuba?

To implement the President’s January 5, 1999 initiative to expand the export of food and agricultural commodities to Cuba, the Department of Commerce, Bureau of Export Administration (BXA), has amended its regulations to allow the sale of food and certain agricultural commodities to non-government entities in Cuba. Applicants may apply to BXA for such exports using the standard Commerce Department Multipurpose Application Form BXA-748P. The United States will approve on a case-by-case basis exports of food (i.e. both solids and liquids normally consumed by humans or animals) and certain agricultural commodities if destined to independent non-government entities, individuals or organizations in Cuba. Such entities may not be controlled, owned or operated by the Cuban government.

Applicants must demonstrate on the application form in block 24, Additional Information, that the prospective end-user is independent from the Cuban government. Independent non-government entities in Cuba include, but are not limited to, religious groups, private farmers and private sector enterprises such as restaurants.
